TERMS & CONDITIONS
The Charlie Hornes Coaching Studio, LLC & The Hornes Acting Studio
Effective Date: December 1, 2024
1. SCOPE & ACCEPTANCE
These Terms & Conditions (“Terms”) govern all services, programs, products, and activities offered by The Charlie Hornes Coaching Studio, LLC and The Hornes Acting Studio (“the Studio,” “we,” “us,” or “our”), including but not limited to:
Private and group coaching services
Acting studio classes and training programs (youth and adult)
Corporate coaching, consulting, speaking engagements, and retreats
Digital products, courses, downloadable materials, and educational resources
Website use, registration forms, communications, and media
By enrolling, purchasing, booking, accessing, or participating in any Studio offering, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. LIMITED ENROLLMENT & COMMITMENT
The Studio operates as a boutique, small-group training environment. Acting studio cohorts are intentionally capped (typically ten (10) students per session).
Enrollment reserves a limited seat and constitutes a firm commitment. Once enrolled, that seat is removed from availability.
3. PAYMENT TERMS (GENERAL)
Full payment is required at checkout unless a payment plan is explicitly offered.
Subscription, installment, or paid-in-full options follow the terms presented at purchase.
Failure to complete payment obligations may result in suspension or termination of services without refund.
4. NON-REFUNDABLE ENROLLMENT (ACTING STUDIO)
All tuition, packages, and program fees for acting studio classes are non-refundable.
Families and adult students may request a transfer of credit to a future session within the same calendar year, subject to availability. Transfers are not guaranteed and are granted solely at the Studio’s discretion.
5. ATTENDANCE & MISSED CLASSES (ACTING STUDIO)
Missed classes are not refundable, transferable, or eligible for make-up sessions.
Due to the ensemble-based nature of training, the Studio does not offer make-up classes. Students who miss a class may be informed of general concepts covered but may not participate unless enrolled. Missed material may reappear in future sessions at the instructor’s discretion.
6. SHOWCASE & SEATING POLICIES
Youth Programs
Each enrolled student includes two (2) complimentary guest seats, subject to venue policies and reservation deadlines.
Additional seating may be ticketed or limited based on capacity.
Wings and Spotlight tiers include upgraded or reserved seating as outlined at purchase.
Adult Programs
All guests require ticket purchase unless otherwise stated.
Seating arrangements are subject to venue policies and deadlines.
The Studio reserves the right to adjust showcase formats, seating logistics, or venues as required, without liability.
7. CONDUCT, PARTICIPATION & STUDIO AUTHORITY
Students are expected to maintain a respectful, collaborative learning environment.
The Studio reserves the right to refuse enrollment, discontinue participation, or remove any student whose conduct undermines safety, instruction, group cohesion, or program integrity. No refunds or credits are issued for dismissal.
Audio or video recording of classes, instruction, or fellow students is prohibited without prior written approval.
8. PHOTOGRAPHY & VIDEO RELEASE | MEDIA CONSENT
By enrolling, parents/guardians (or adult students) grant permission for the participant to be photographed or recorded during classes, rehearsals, showcases, or related Studio activities.
Media may be used for:
Studio documentation and internal records
Educational review and instructor assessment
Family keepsakes and optional add-on products
Promotional and informational materials (website, social media, print, email, digital platforms)
Images may be edited for presentation. No identifying personal information will be publicly attached without additional consent. Media will not be sold to third parties or used outside Studio-related purposes.
Participation constitutes consent unless a written opt-out request is submitted prior to the start of the session.
9. HEALTH, SAFETY & ASSUMPTION OF RISK
Participation involves physical movement, spatial awareness, and ensemble interaction.
Participants (or parents/guardians) acknowledge and assume all inherent risks associated with acting, movement-based instruction, and in-person participation, and release the Studio, its instructors, staff, affiliates, and venue partners from liability for injuries or incidents arising from ordinary participation.
Relevant medical, behavioral, or accessibility needs must be disclosed prior to participation.
10. REHEARSAL ATTIRE & FOOTWEAR (ACTING STUDIO)
All students must comply with Studio attire and footwear standards, including rehearsal blacks and professional, soft-soled shoes.
Failure to meet requirements may result in removal from class for that session without refund or credit.
Shopping recommendations are provided for convenience only. The Studio is not responsible for product selection, sizing, fit, materials, or returns.
11. PARENT/GUARDIAN VOLUNTEER ROTATION (PROGRAMS INVOLVING MINORS)
To comply with venue and Studio child-safety policies, each enrolled family agrees to participate in one (1) rotating adult volunteer session per program cycle unless the roster is already complete.
Volunteers must be at least eighteen (18) years of age and remain present for the full class duration. Scheduling is coordinated by the Studio. This requirement is a condition of enrollment.
For private coaching involving minors, a parent or guardian must remain on site.
12. COACHING SERVICES — REFUNDS, CANCELLATIONS & DISCLAIMERS
Subscription payments are non-refundable once processed. A minimum fourteen (14) day written notice is required to cancel subscriptions.
Missed sessions, late arrivals exceeding fifteen (15) minutes, or no-shows are forfeited.
Coaching is not therapy, counseling, or medical treatment and does not replace licensed mental health care. No specific outcomes or results are guaranteed.
13. CORPORATE COACHING, SPEAKING & PROGRAMS
Corporate and institutional engagements require a non-refundable deposit (typically 50%), with balance due per contract terms.
Cancellation, rescheduling, travel, and force majeure terms are governed by the agreement executed at booking. No refunds are issued for no-shows or late cancellations.
14. DIGITAL PRODUCTS, COURSES & DOWNLOADS
All digital products, courses, and downloadable materials are non-refundable once accessed or delivered.
Access is licensed to the purchaser only. Sharing, redistribution, or credential sharing is prohibited.
15. INTELLECTUAL PROPERTY & INSTRUCTIONAL MATERIALS
All content, methodologies, curriculum, exercises, class structures, demonstrations, staging, adaptations, branding, and training processes are the exclusive intellectual property of The Charlie Hornes Coaching Studio, LLC and/or The Hornes Acting Studio.
Materials are licensed for personal, in-studio or personal-use only. Recording, reproducing, distributing, teaching, posting, performing, or using materials outside Studio activities without written permission is prohibited.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Studio’s total liability for any claim shall not exceed the amount paid by the participant for the applicable service.
The Studio shall not be liable for indirect, incidental, consequential, special, or punitive damages.
17. INDEMNIFICATION
Participants (or parents/guardians) agree to indemnify and hold harmless the Studio, its instructors, staff, affiliates, and venue partners from any claims, damages, losses, or expenses arising from participation, policy violations, or misuse of Studio materials.
18. FORCE MAJEURE & PROGRAM CHANGES
The Studio may modify schedules, faculty, locations, or programming due to illness, weather, venue availability, emergencies, or circumstances beyond its control. Such changes do not entitle participants to refunds or credits.
19. MODIFICATION OF TERMS
The Studio reserves the right to update these Terms at any time. Material changes will be communicated via email or website notice. Continued participation constitutes acceptance.
20. GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved exclusively in courts located within Texas.
21. SEVERABILITY
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
22. AGREEMENT TO TERMS
By enrolling, purchasing, booking, or participating in any Studio offering, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
